Third Circuit Court of Appeals Nukes New Jersey’s Assault Weapons and Magazine Bans
The Federal Third Circuit Court of Appeals released their opinion today in Cheeseman v. New Jersey and oh boy is it a treasure. The en banc decision, written by Justice Arianna Freeman, a Biden appointee no less, demolishes the state’s ban of assault weapons saying that it applies to all semi-automatic firearms regardless of make and model. It also uses the phrase “the text of the Second Amendment covers all magazines.” This decision is a complete takedown of any argument claiming that common use means anything other than ownership.

The downside however, is that this decision will have absolutely no effect on Massachusetts or the other states not covered by the Third Circuit. Massachusetts, unfortunately, resides within the First Circuit. Our only hope is that the Supreme Court sees the cogent, intelligent and correct arguments made within this opinion and rule correctly when they are faced with the Grant and Viramontes cases this coming fall. For now, we will just have to settle with being happy for our fellow patriots in New Jersey and continue our fight here in the Commonwealth.
